Terms and Conditions

Sienna Bathware Pty Ltd (ABN 42 355 631 081) (“Sienna Bathware”, “we”, “us”, “our”) operates the website located at siennabathware.com.au (the “Site”). These Terms and Conditions (“Terms”) govern your access to and use of the Site and the purchase of products from us. By using the Site, creating an account, or placing an order, you agree to be bound by these Terms.
1. Definitions and interpretation
- ACL means the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
- Business Day means a day other than a Saturday, Sunday or public holiday in Victoria.
- Consumer has the meaning given in the ACL.
- Goods means any products offered for sale by Sienna Bathware via the Site.
- Headings are for convenience only and do not affect interpretation. A reference to “including” means “including without limitation”.
2. Website use and account
- You must be at least 18 years old to place an order.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity on your account.
- You must not misuse the Site, interfere with security features, or use the Site for unlawful or fraudulent purposes.
- Content on the Site is general information only and not design, building or plumbing advice. You should obtain independent advice suitable to your circumstances.
3. Product information and availability
We use reasonable care to ensure descriptions, dimensions, finishes, certifications (e.g., **WaterMark**, **WELS**) and images are accurate; however, minor variations in colour/finish, grain, or patina (e.g., living finishes such as raw brass) may occur and do not constitute defects.
Goods are subject to availability. We may withdraw or substitute Goods without notice. If an item is unavailable after you place an order, clause 6 applies.
Images may show props or complementary products not included in the price unless expressly stated.
4. Pricing, taxes and promotions
- Prices are in **AUD** and, unless otherwise stated, **include GST**. Freight charges, if any, are shown at checkout.
- We may correct pricing or typographical errors (E&OE). Where an obvious error affects your order, we may cancel and refund (see clause 6).
- Promotional codes must be entered at checkout and cannot be applied retrospectively, combined (unless stated) or redeemed for cash.
- Gift cards/store credits are non-refundable, transferable only as permitted by law, and (unless otherwise required by law) have a minimum expiry of **3 years** from issue.
5. Payment
- We accept the payment methods shown at checkout (e.g., Visa/Mastercard, Amex, PayPal, select BNPL).
- Payment is processed at the time of order. Your order is not accepted until we issue an **Order Acceptance/Tax Invoice** (see clause 6).
- If payment is reversed or dishonoured, we may suspend or cancel the order and recover any reasonable costs incurred.
6. Orders, acceptance and cancellations
6.1 Your order constitutes an offer to purchase Goods under these Terms.
6.2 We will acknowledge receipt by email, but **acceptance** occurs only when we send an **Order Acceptance/Tax Invoice**.
6.3 We may cancel an order (and refund any amount paid) where:
(a) the Goods are unavailable;
(b) we reasonably suspect fraud or misuse;
(c) there is a material pricing/description error; or
(d) payment cannot be processed.
6.4 You may not cancel or vary an order once accepted without our written consent. **Custom or special-order items** (including made-to-order finishes, cut-to-size or non-stock items) are **non-cancellable and non-returnable** except under the ACL.
6.5 We may allow **backorders/pre-orders**. Lead times are estimates only and may be affected by supplier or freight delays.
7. Title, risk and PPSA
- **Risk** in the Goods passes to you upon delivery to the delivery address (including where an Authority To Leave is exercised).
- **Title** passes to you upon our receipt of **cleared funds in full** for the Goods and any delivery charges.
- Until title passes, you: (a) hold the Goods as bailee, (b) must keep them in good condition and separate/identifiable, and (c) must not encumber them.
- You grant us a **security interest** in the Goods (and their proceeds) to secure payment. We may register this interest under the *Personal Property Securities Act 2009 (Cth)* (PPSA). You waive any right to receive PPSA notices to the extent permitted by law.
8. Delivery and inspection
We deliver to the areas shown at checkout. Free shipping offers may be available from time to time, based on thresholds and conditions determined at the sole discretion of Sienna Bathware Pty Ltd. Details of current shipping offers will be displayed on the Site.
Delivery timeframes are estimates only. We are not liable for delays caused by third-party carriers, customs, industrial action, severe weather or other events beyond our control.
Where you grant **Authority To Leave (ATL)**, delivery occurs when the Goods are left at the address; risk passes at that time. Re-delivery or futile delivery fees may apply if no one is available to accept delivery.
You must **inspect the Goods on delivery** and notify us in writing within **7 days** of delivery of any short supply, damage or incorrect items. To assist assessment, provide clear photographs and the packaging label.
9. Returns, change-of-mind and refunds
9.1 **Change of Mind (consumer orders):**
* Return within **60 days** of delivery for a **refund** of the product price (shipping and return freight excluded), provided the Goods are **unused**, **uninstalled**, in **original, undamaged packaging** (including all accessories/fixings) and pass our inspection.
* Requests made **60–90 days** from delivery may be eligible for **store credit** at our discretion.
* You are responsible for safe return freight and transit risk.
* We may deduct reasonable amounts for missing/damaged parts, non-resalable packaging or cleaning required.
9.2 **Exclusions:** Custom or special-order items, cut lengths, clearance items marked “final sale”, and items that have been installed or attempted to be installed are not returnable unless faulty under the ACL.
9.3 **Return process:** Contact **[support@siennabathware.com.au](mailto:support@siennabathware.com.au)** for an RMA and return instructions. Returns without an RMA may be refused.
9.4 Refunds are processed to the original payment method once inspection is complete.
9.5 Nothing in this clause limits your rights under the ACL.
10. Australian Consumer Law – mandatory notice
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a **replacement or refund for a major failure** and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods **repaired or replaced** if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
11. Warranties (manufacturer)
11.1 In addition to your ACL rights, Goods are supplied with the manufacturer’s express warranty applicable to the product (as stated on the relevant product page/packaging).
11.2 Warranty periods for Sienna Bathware branded Goods are as follows:
Residential use: 24 months from the date of purchase;
Commercial use: 12 months from the date of purchase.
11.3 Warranty coverage generally applies to manufacturing defects only. It does not cover misuse, improper storage, normal wear and tear, surface patina, water quality issues (e.g., scale/corrosion), damage from harsh or abrasive cleaners, acts of God, or installations not performed by a licensed professional.
11.4 We may require detailed photos/video, proof of purchase, and access for inspection. Do not remove or uninstall Goods without our written direction, as removal costs are generally not covered.
11.5 Any replacement or repaired component will be warranted for the balance of the original warranty period.

12. Installation and product care
- Many Goods must be installed by a **licensed plumber/electrician**. Incorrect installation may cause property damage and will void warranty.
- Observe all product-specific installation instructions, maximum operating pressures and water temperature limits. Remove flow restrictors or check valves **only where permitted**; doing so may void WELS compliance and warranty.
- Follow our care instructions. Avoid abrasive pads/chemicals; use mild soap and soft cloths. Some finishes are “living finishes” and will naturally age.
13. Limitation of liability
- To the extent permitted by law, our liability for breach of a non-excludable guarantee is limited, at our option, to replacement, repair, resupply or refund of the Goods.
- We exclude all liability for **indirect or consequential loss**, loss of profit, loss of opportunity, or damage to surrounding property arising from misuse or incorrect installation, except where such exclusion is prohibited by the ACL.
- Nothing in these Terms excludes liability for death or personal injury caused by our negligence or fraud.
14. Intellectual property and reviews
The Site and its content (including text, graphics, logos, product imagery and designs) are owned by or licensed to Sienna Bathware and are protected by IP laws. You must not reproduce, adapt or exploit any content without our written consent.
If you submit reviews, photos or other content, you grant us a **worldwide, royalty-free, perpetual licence** to use, reproduce, modify and publish such content for marketing and customer service purposes. You warrant you own that content and it does not infringe third-party rights.
15. Trade customers (if applicable)
Trade pricing or accounts are at our discretion. Separate terms may apply and prevail to the extent of any inconsistency.
Trade/volume special orders are non-cancellable and non-returnable except under the ACL.
16. Promotions, samples and bundles
Promotional bundles are sold as a set; partial returns are not permitted unless required by the ACL.
Any samples provided are indicative only; natural materials may vary in colour, tone or veining.
17. Privacy and data security
We handle personal information in accordance with our **Privacy Policy** and the *Privacy Act 1988 (Cth)* including the Australian Privacy Principles.
You consent to us using your contact details to communicate about your orders and (where you opt-in) marketing. You may unsubscribe at any time.
18. Force majeure
We are not liable for delay or failure to perform where caused by events beyond our reasonable control (including supplier delays, natural disasters, epidemics, transport interruptions, or governmental action). We will use reasonable endeavours to mitigate and resume performance.
19. Amendments, severability and assignment
- We may amend these Terms by posting an updated version on the Site. The Terms in force at the time you place an order will apply to that order.
- If any provision is invalid or unenforceable, it will be read down to the extent necessary or severed without affecting the remaining provisions.
- You must not assign your rights under these Terms without our consent. We may assign or novate our rights to a related body corporate.
20. Governing law and disputes
These Terms are governed by the laws of **Victoria, Australia**.
If a dispute arises, you agree to first notify us and allow **14 days** to attempt resolution. If unresolved, the parties submit to the **exclusive jurisdiction of the courts of Victoria** (or, where applicable, VCAT). Nothing prevents a party seeking urgent injunctive relief.
